ILLUSTRATED SURVEY OF THE COMPETENCE IN WORK-OUT OF TOWN PLANNING DOCUMENTATIONIn the operations of the Secretariat for Town Planning one of the rather important fields of work is EFFECTUATION of the plans.The procedure which develops for the purpose of providing information on the possibilities and limitations of arrangement of the space (purpose of use of the lots), town planning license (with town planning – technical and other conditions) and town planning approval of the technical documentation, can be taken ,as per the Town planning and the law, as permanent and/or temporary documentation. Also, depending on the zone in which the structures are located, as per the plan and the law, and also as per the requirement they are carried out in co-operation with the Institute for the protection of the Monuments of Culture. The areas in the plans which have not been elaborated, are effectuated by a complex procedure as per the new "GUP" – General Town Planning by town planning analysis.

1 Request for information on possibilities and limitations of the araregemnt of the space (purpose of use of the lot or the structure) with an inquiry on construction capacities as per the plan possibility of formation of a construction lot, first information whether co-operation should be made with the protection service , is submitted to:The Secretariat for Town Planning ( counter service within the municipalities).The following is enclosed to the request:- Copy of the lot or structure plan- Written application.

2.Request for Work-out of the Town Planning license: is submitted toThe Secretariat for Town Planning in 27. marta street No. 43-45 (counter service) for legal entities;Secretariat for Town planning within the municipalities – for natural persons.

The following is enclosed to the request:copy of the lot plan,information on the purpose of use of the lot,certificate on formation of the construction lot,evidence on acquiring the right of use of the land for the construction purpose, or agreement and decision on acquiring the right to convert the common areas into housing, business area and other legal documents,property document,preliminary design of the requested intervention, pursuant to the information on the purpose of use of the lot and the structure,construction program,if the building is under protectorate, then conditions of preservation.

3. Agreement for the work-out of the town planning – technical conditions is signed with the "Town Planning Bureau", Palmoticeva street No. 30, upon receipt of the letter with the instructions of the Secretariat for Town Planning, accompanied by the previously listed documentation."Town Planning Bureau" Palmoticeva street No. 30.Upon receipt of the letter with the instructions of the Secretariat for Town Planning given to the Town Planning Bureau, a written application for work-out of the conditions is submitted , accompanied by the previously listed documentation.Information on the price of work-out of the conditions, or work-out of the plan, analysis and similar, is obtained upon the survey made of the real scope of the works in work-out of the conditions by the Town Planning Bureau. Depending on the type of structure, size of the lot, etc, the price is formed, and co-operation with the utilities companies is carried out and similar.

4. Town Planning analysis for intervention as per the new General Town Planning can be requested through:Secretariat for Town Planning and Town Planning BureauWith the request the following is enclosed: copy of the lot plan, drawing and other available documentation.The Town planning analysis fee is paid to the Town Planning Bureau.Town planning analysis is done for the structures where Detailed Town Planning (DTP) has not provided sufficient elements, or there is no DTP and there are other town planning elements for consideration. The analysis result is not always the stage towards work-out of the town planning conditions.The results of the analysis are directed towards work-out of the town planning – technical conditions (TPTC) as per the described procedure, or possibly change of plan documentation.

5. Initiatives, proposals and suggestions of the interested natural persons and legal entities or owners or users of the city land, in the field of the Regulations plans and Town planning designs, the work-out of which is in the process, are submitted in writing. It is necessary to explain actually your description by a drawing, or documentation, etc.

6.Secretariat for Town Planning. In the course of the public inspection of the draft of the Regulation plan the time of which effectuation is advised by mass media, it is possible to become familiar with the state of affairs in the plan, and also submit in writing the initiatives, suggestions, proposals of the interested parties.They are to be submitted directly to the Secretariat for Town Planning.

TOWN PLANNING LICENSE

  1. The Investor submits the request to the Republic Geodesy Bureau for obtaining of the Copy of the Plan.
  2. Copy of the plan (Republic Geodesy Bureau).
  3. The Investor submits the request for Information on the possibilities and limitations of the arrangement of the space, purpose of use of the lots ( Secretariat for Town Planning)
  4. Secretariat for Town Planning provides the Information on the possibilities and limitations of the arrangement of the space, purpose of use of the lot/structure.
  5. The Investor submits the request for the Town planning license (Secretariat for Town Planning.
  6. The Secretariat for Town Planning orders Town planning-technical and other conditions from the Town Planning Bureau.
  7. The Investor signs the Agreement for work-out of the town planning – technical and other conditions with the Town Planning Bureau of the City of Belgrade.
  8. The Town Planning Bureau prepares town planning conditions and submits them to the Secretariat for Town Planning.
  9. The Secretariat for Town Planning inspects the conditions and grants Town planning license to the Investor.
  10. The Investor takes over the Town planning license.

CLARIFICATION OF THE PROCEDURE:

  1. REQUESTThe interested party submits the request for issuing of the town planning license to the Secretariat for Town Planning.
  2. The party encloses the Information on the possibilities and limitations of the arrangement of the space, purpose of use of the lot (issued by the Secretariat for Town Planning on the basis of the DTP or Regulation plan through which the possibility of construction has already been considered).Copy of the plan and other supporting documents obtained from the Republic Geodesy Bureau.Property decisions, contracts and other legal documents in respect to the right to use the land, space, etc,The party encloses the preliminary drawing or preliminary design.

  3. INSTRUCTIONThe Secretariat for Town Planning checks the authenticity of the enclosed documentation on the basis of the conformity of the Request of the party with the possibilities of the town planning documentation, as per the Information on the purpose of use of the lot, Plan, Law, Regulations as well as per the property-legal documentation.When the conditions are met, the Secretariat for Town planning orders preparation of the study of the Town planning – technical conditions by a letter comprising detailed information on the condition of the Plan documentation, property-legal; basis, legal regulations, obligations of the party and the role of the Town planning Bureau in the work-out of the conditions.
  4. WORK-OUT OF THE CONDITIONS The Town Planning Bureau works-out the conditions. Thus prepared conditions are submitted to the Secretariat for Town Planning.SMALL CONDITIONS WITHOUT CO-OPERATION OF THE PUBLIC UTILITIES COMPANIES
  5. NOTE: Town Planning Bureau reads the Town Planning-technical conditions from the existing plans. It uses necessary analyses worked-out in the previous stage.

    BIG CONDITIONS IN CO-OPERATION WITH PUBLIC UTILITIES COMPANIESNOTE: In these conditions the co-operation with the Institute for Protection of the Monuments of Culture is realized if required, and particularly with all Public Utilities Companies, suppliers of the infrastructure capacities, ad other institutions and similar.The Town Planning Bureau, upon receipt of all conditions, works out the study and in accordance with it and the law has it verified by the competent authorities and organizations which participated in its preparation.

  6. INSPECTIONThe Secretariat for Town Planning checks whether such prepared condition is in accordance with the instructions for work, Information on purpose of use, Copy of the plan, Plan of the Detailed Town Planning or Regulation plan, Laws, regulations, as well as in accordance with the property legal documentation, special conditions and carried out contractual co-operation.
  7. TOWN PLANNING LICENSE WITH CONDITIONS – CONDITIONS SEPARATELYThe Secretariat for town Planning issues the town planning license to the person who enclosed the evidence on the right of use of the space, property legal documentation, and as per the conditions from the plan and Town planning – technical documentation. WORK-OUT OF THE PLAN DOCUMENTATION IN THE ASSEMBLY OF THE CITY OF BELGRADE

Initiative for the work-out of the Plan can be started as per the determined requirements for the work-out of the Town planning by:Municipality, group of citizens, individual investors, Assembly bodies, professional organizations and similar.

Funds for the Plan are provided by:

Directorate for the city land, and for the plans that are not in the annual program they are financed as per a mutual agreement by the Investor with the basic institutions.

Starting the initiative for work-out of the planThe investor submits the initiative through: the Secretariat for Town Planning, Directorate for City land, Town Planning Bureau, or through the Executive Board of the City Assembly.

  1. The Secretariat for Town Planning carries out co-operation with the Town Planning Bureau and Directorate of construction
  2. The Town Planning Bureau provides their opinion on the scope of the plan, on the effects of the previous plan solutions upon the Investor’s request and vice versa, gives suggestion on the character of the solutions and limitations, realizes co-operation with other institutions.
  3. "The Directorate" provides the opinion on other effects of the future solution and necessity of the infrastructures solutions, property status, their knowledge on the location and possible realization.
  4. The Secretariat analyses the submitted documentation , may request the opinion of the other institutions, and prepares the decision.
  5. Directs to the Committee for Architecture and Town Planning of the City Assembly against consultations with the resource member of the Executive Board in charge of town planning
  6. Secretariat for Town Planning prepares the records for the committees and informs the Executive Board of the proposal of the decision and advises on the attitude of the committee.
  7. The Executive Board takes the proposal of the decision into consideration. The accepted decision is delegated to the Assembly – to the members of the committees for consideration.
  8. Council for Town Planning of the City Assembly gets to know the proposal of the decision, and presents it to the members of the committees of the group. They present their report to the Executive Board (EB), namely to the member of the EB in change of Town Planning. If they have some serious comments they make and Amendment and the EB decides on it and the Secretariat for Town Planning provides their opinion against possible consultations with the Town Planning Bureau and Directorate.
  9. The City Assembly takes the documentation into consideration and makes the decision,
  10. The Secretariat sends a letter instructing the Town Planning Bureau to work-out the Plan.
  11. The Town Planning Bureau presents their requirements in respect to the work-out of the plan to the Directorate for Construction land which pays the base documentation and analyses.
  12. The Republic Geodesy Bureau prepares base documentation and submits them to the Directorate for the Town Planning Bureau.
  13. The Town Planning Bureau orders the necessary analyses, prepares proposal of the solution, carries out co-operation with the Public utilities companies, Institute for the Protection of the Monuments of Culture, Nature, etc, and forwards one copy of the draft Plan proposal for control

14. The Secretariat for Town Planning inspects the study, possibly provides necessary suggestions in respect to the procedure, questions in respect of possibility to effect it and legality of the applied solutions, and if everything is in order, the Town Planning Bureau submits a sufficient number of copies of the draft Plan proposals for the committee work.

  1. The Committee for Architecture and Town Planning takes the documentation into consideration, provides their opinion, and if positive, it is worked-out further for Assembly consideration.
  2. Secretarait for Town Planning prepares the records for the committees and informs the EB on the copy of the draft Plan proposal and informs on the standpoint of the committee, however, also provides the recommendation on the public course of work. If necessary, the plan is submitted to The Ministry for Constructions for approval.
  3. The EB takes the documentation into consideration, and if accepted the Draft Plan is further prepared for public inspection. After the letter from the Office of the Assembly Affairs and Regulations is received, the Secretariat informs the present participants on making the decision on the outcome of the work.
  4. The Secretariat provides in a letter form the instructions to the Town Planning Bureau to prepare the Plan for Public Inspection.
  5. Public Inspection is announced by and advertisement which is prepared by the Secretariat for Town Planning and published through the Secretariat of Information in the mass media – 15 days from the date publishing the advertisement the Public Inspection begins. By sending out letters the Secretariat for Town Planning advises The Association of Town Planners, Directorate for Construction land, The Municipality on which Territory the Plan is prepared, Ministry of Construction on publics inspection taking place and requests them to elect their representative, who together with the representative of the City elected by the Secretariat make the Expertly Committee of the City Assembly for public inspection
  6. The Town Planning Bureau exhibits the documentation which is previously verified by the stamp of the Secretariat on graphic enclosures, and provides constant presence of the participant in preparation of the said documentation during the public inspection.
  7. During the public inspection the interested parties submit their comments to the Secretariat for Town Planning, which in turn processes them successively, classifies and forwards to The Town Planning Bureau and members of the Committee.
  8. The Session in respect of the public inspection is carried as per the specified schedule upon expiry of the Public inspection (one or more) where all who have submitted their written comments may elaborate them orally.
  9. The Town Planning Bureau submits in writing their replies to The Secretariat for Town Planning, which forwards them to the committee and arranges for the assistance to the committee in their work.
  10. The Committee for public Inspection studies the received comment and replies, provides their opinion in respect to them, as well as its individual remarks, and submits the Minutes on the public inspection to The Secretariat for Town Planning. The Minutes are signed by the members of the committee. Such report with an Explanation and proposal is submitted by The Secretariat for Town Planning to the EB of the City Assembly against previous consultation with the member of the EB in charge of the work within town planning.
  11. EB takes the Plan proposal ito consideration
  12. And forwards it to the Assembly – to the members of the committees for consideration. The Council for Town Planning of the City Assembly becomes familiar with the proposal of the Plan, and presents it to the group members of the committees group. (The citizens who are aware of the replies to the questions asked, may request through the Group member of the committee the Amendment of the solution from the Plan). They submit their report to the EB – namely to the member of the EB in charge for Town planning/ If they have serious remarks – Amendments – they are decided on by the EB and the Secretariat for Town Planning (provides their opinion against possible consultations with the Town Planning Bureau and Directorate).

  13. The City Assembly takes the documentation proposed by the EB into consideration and if they accept the plan, The Assembly Affairs advise the Secretariat for Town Planning on the outcome of the Assembly work and request the documentation for publishing in the Official Gazette of the City of Belgrade (text)
  14. The Secretariat for Town Planning submits the original of the text obtained form the Town Planning Bureau, for publishing in the Official Gazette of the City of Belgrade through The Assembly Affairs and Regulations. ( In co-operation with the person working on the Plan preparation may make corrections of the text upon the request of the Assembly).
  15. The Secretariat instructs by a letter the Town Planning Bureau to prepare necessary number of the copies of the Plan study, three copies of the original are signed by the Mayor of the Assembly of the City of Belgrade, and the copies are verified with a signature by the Secretariat for Town Planning.
  16. The verified copies of the study are submitted to the City Assembly, Town Planning Bureau, municipality and the Directorate, and to the Investor of the Plan, and a copy of it is kept with the Secretariat.

STEPS TOWARDS OBTAINING TOWN PLANNING LICENSES, TOWN PLANNING APPROVAL AND CONSTRUCTION LICENSE

  1. The Investor submits a request to the Republic Geodesy Bureau for obtaining a copy of the Plan.
  2. Copy of the Plan (Republic Geodesy Bureau).
  3. The Investor submits a request for Information on the possibility and limitation of arrangement of the space, purpose of use of the lot. (Secretariat for Town Planning).
  4. Secretariat for Town Planning provides the Information on the possibility and limitation of arrangement of the space, purpose of use of the lot.
  5. The Investor submits the request to the Institute for Protection of the Monuments of Culture for the conditions of preservation
  6. The Institute for Protection of the Monuments of Culture issues the Decision on the conditions of preservation.
  7. The Investor submits the application for obtaining of the Town planning license and town planning conditions (Secretariat for Town Planning) with property decision and conditions of preservation, and other legal documents, sketches, programs, supporting documentation, etc.
  8. The Secretariat for Town Planning orders town planning conditions from the Town Planning Bureau.
  9. The Investor signs the Agreement on work-out of town planning – technical and other conditions with "The Town Planning Bureau" of the City of Belgrade
  10. "The Town Planning Bureau" prepares the town planning conditions and submits them to the Secretariat for Town Planning.
  11. The Secretariat for Town Planning inspects the conditions and issues the town planning license to the Investor.
  12. The Investor takes over the town planning license; pays the tax personally.
  13. The Investor submits the request for Town planning approval to the Secretariat for Town Planning with all conditions and approvals of the public utility companies; some of them being:Water supply company,Sewerage company,Electricity Distribution Board,Belgrade Electric Power Plants, Chimney sweeping company,Telephones Belgrade (PTT),Ministry of Internal Affairs - Firefighting police administration,Protocol of regulation and similar,With the approval of "The Institute for the Protection of the Monuments of Culture"Other necessary approvals as per the law.
  14. The Secretariat for Town Planning grants the town planning approval, if the main design is in accordance with the Town planning license.
  15. The Investor submits the request to "the Directorate for City land" – for calculation of compensation for the construction land.
  16. The Directorate and the Investor sign the Agreement
  17. The Investor submits the request to the JKP (Public Utilities Company) Shelters for participation.
  18. JKP-PUC Shelter and the Investor sign the agreement on participation.
  19. The Investor submits the request for construction license.
  20. Construction license
